MOPTIL company presents DIGIPAST, a Virtual Reality tour that revives the Cultural Heritage monuments. MOPTIL has designed and implemented immersive experiences in Acropolis of Athens, Knossos, Rhodes: Kamiros and Acropolis of Lindos, Delos, Epidaurus, Mycenae, Ancient Olympia, Asclepius of Kos, Delphi. We offer you, under the supervision of renowned archaeologists, Virtual Reality Apps for exploring archaeological sites through your smartphones, tablets and web browsers.

Any transaction with us is governed by the following terms, as updated from time to time, which we invite you to read carefully before each transaction. Your use of our services implies your acceptance of these terms of use. If the visitor/user does not agree with the terms of use herein, he/she must not use the services and its content.

These terms of use may be revised and updated at any time and without notice. Please check our terms of use periodically as your continued use of the website and application implies that you accept these changes.

Intellectual property is acquired without any formality and without the need for a clause prohibiting its infringement. All the content of our services, except for that which is subject to third party copyright, is the intellectual property of MOPTIL and is protected by applicable law. Any other use requires the express written permission of MOPTIL or the third-party copyright holder.

You acknowledge and agree that MOPTIL (or its licensors) retain all right, title, and interest in and to the services provided. You agree not to reproduce, copy, duplicate, sell, trade or resell the services and their outcomes for any purpose. You also agree not to reverse compile, disassemble, reverse engineer, or otherwise reduce to human-perceivable form all or any part of the application; gain access to all or part of the application and/or the source code to build a competitive product or service; or in order to replicate the features, functions or graphics of the application; use the application in order to provide services to third party companies or individuals, grant use, lease, transfer, assign, distribute or exploit commercially in any other way, gain unauthorized access and use to the application.

Nothing in the Terms grants you the right to use MOPTIL's or DIGIPAST’s trade name, trademark, service mark, logo, and other distinctive features. The user acquires only a simple license to use the application.

The application provides access to third party websites through appropriate links. External links refer to sources outside the control of MOPTIL. These links have been placed solely for the convenience of the users of the application, while the websites to which they refer are subject to the respective terms of use of these websites. The placement of the links does not constitute an indication of approval or acceptance of the content of the respective websites by MOPTIL, which is not responsible for their content or for the privacy practices, personal data protection or the accuracy of the materials contained therein. If the user of MOPTIL decides to use, through its links, any of the third-party websites, he/she accepts that he/she does so at his/her own risk.

The processing and protection of the personal data of the user of the application is subject to the terms of the Privacy Policy section, as well as to the provisions of national, European, and international law on the protection of individuals regarding the processing of personal data, as applicable.

Accordingly, the Privacy Policy may be revised and updated at any time and without notice. Users of the application are kindly requested to check the Privacy Policy section periodically for any changes, as continued use of the application implies acknowledge of all possible amendments thereto.

MOPTIL has complied and adheres to the applicable legislation on the protection of your personal data and the relevant instructions and guidelines of the Hellenic Data Protection Authority, carrying out regular checks and training our staff in the observance of a holistic security and privacy plan.

For MOPTIL the integrity and confidentiality of your information is a constant priority whether you download our store apps (mobile applications) or access directly through your browser (web application).

About our store apps, for your safety and convenience MOPTIL provides DIGIPAST exclusively through the App (Apple Inc.)/Play Store (Google LLC), which ensure that our app comes from a verified source, is free of known malware, and hasn’t been tampered with at the time of installation or launch. App/Play Store use an encrypted protocol for secure online commercial transactions, in accordance with current standards and security specifications, via a secure banking environment. To ensure the confidentiality of data transfer, they use an appropriate encryption protocol. In this way, all your personal information is encrypted so that it cannot be read or changed during its transfer on the Internet. An encrypted communication requires all information sent between a client and a server to be encrypted by the sending software and decrypted by the receiving software, thus protecting personal information in transit.

In addition, all information sent is protected by a mechanism that automatically verifies whether the data has been changed in transit. For the latest security measures please refer to the App/Play Stores.

When you access through your browser, appropriate technical and organisational measures are also applied. Our web application employs industry-standard security protocols to protect your data during transmission and storage. We utilize HTTPS encryption to ensure that all data exchanged between your browser and our servers remains confidential and secure. Regular security assessments are conducted to identify and mitigate potential vulnerabilities.

In both cases, measures include, but are not limited to: measures to prevent unauthorised access to data processing systems; measures to ensure that data processing systems cannot be used by unauthorised persons; measures to ensure that persons authorised to use data processing systems only have access to the data for which they are authorised; measures to ensure that personal data cannot be used by unauthorised persons during processing; measures to ensure that personal data cannot be transmitted, copied, altered or removed by unauthorised persons during electronic transmission or during the course of transmission or recording, and that it is possible to verify and authenticate the processors to whom personal data has been transmitted by means of devices; measures to ensure that it is possible to subsequently review and verify whether and by whom personal data have been entered, modified or deleted in the data processing systems, measures to ensure that personal data processed by third parties/contractors are only processed in accordance with our instructions, and measures to ensure that data collected for different purposes can be processed separately.

Be extremely careful if you download content from the internet. Some downloads available on the internet may not contain the software they claim to contain or may contain software you did not expect or did not want. This includes applications that request the installation of configuration profiles, which can then control your device. If installed, any unknown or unwanted software may become a means of intrusion and nuisance and may even damage your device and steal your data.

To avoid unwanted, misleading, or malicious software, install software from the App/Play Store or download it directly from the developer's website.

The content of the services of MOPTIL or its licensors is provided "as is" and "as available". MOPTIL or, where applicable, its licensors, declare that the services lawfully provide the features indicated therein, subject to any technical or typographical errors which have been overlooked or have occurred unintentionally or due to any server downtime for reasons of force majeure, but do not declare or guarantee that your use of the services will meet your requirements, since you must have checked beforehand that such use meets the requirements and specifications of the services. MOPTIL cannot guarantee uninterrupted use of the application, as it depends on server availability and user network conditions.

Updates are carried out based on the availability of the material and possibly without a predetermined periodicity. MOPTIL is not responsible for the integrity, correctness, non-infringement, or suitability of this content, particularly the content of our third-party partners, for any use, application, or purpose.

MOPTIL is not responsible for any technical problems that users may encounter when attempting to access the services due to device compatibility or internet connection quality. Also, MOPTIL has no responsibility for acts or omissions of third parties and in particular unauthorized interventions of third parties in services and/or information available through it.

Under no circumstances, including in case of negligence, is MOPTIL liable for any form of damage suffered by the users who engage with the services, options, and contents of the application on their own initiative and with knowledge of these terms. Furthermore, MOPTIL does not guarantee that the services, options, and contents will be provided without interruption, without errors, that errors will be corrected or that answers will be given to all questions raised. MOPTIL always maintains partnerships with reliable and leading partners. However, it does not guarantee that the servers through which the content is made available to users are provided free of viruses or other harmful components. The cost of any corrections or servicing is borne by the user and in no case by MOPTIL.

By using DIGIPAST you agree that your use of the services constitutes a limited, not-exclusive, non-transferable, and revocable license to use the services for personal and non-commercial purposes on a device that you own or control, solely for the purposes permitted by (a) the Terms and (b) applicable law, regulation, or common practice and that you will not engage in any illegal or unlawful activity for which MOPTIL is expressly and irrevocably released from any liability.

You agree that you are solely responsible (and that MOPTIL shall have no liability to you or any third party) for any breach of your obligations under the Terms, and for the consequences of any such breach (including any loss or damage, whether positive or consequential).

MOPTIL offers you high quality augmented and virtual reality services, which you can access by either downloading DIGIPAST from the App Store or Play Store or accessing it via a web browser.

After having activated your account on one of these providers, you can proceed with in-app purchases including online access to archaeological sites. Current price points are marked in the web app interface and App/Play Store.

Payments are processed through a secure online payment platform. MOPTIL does not store your payment information directly. All payment transactions are encrypted and processed through trusted third-party payment processors that comply with industry-standard security practices to protect your data during transactions.

By paying for access to the DIGIPAST app services and confirming your payment, you consent to the immediate commencement of service. In accordance with Article 3(ib)(a) of Greek Law No. 2251/1994 on consumer protection, you acknowledge that this consent waives your right to withdrawal once access has been granted to the digital content.

During the online payment process you will be asked to confirm the purchase or not. Uninstalling the app by the user does not constitute cancellation of purchase.

The above terms of use of the application, as well as any modification or change thereof, are governed by Greek national law, European law, and the relevant international treaties.

You agree that if MOPTIL does not exercise or enforce any legal rights or remedies described in the Terms or which are MOPTIL's rights under applicable law, such practice shall not be construed as a formal waiver of MOPTIL's rights and that such rights and remedies shall continue to be available to MOPTIL.

If any judicial authority having jurisdiction to make decisions relating to such matters determines that certain provisions of these Terms are invalid, then such provisions shall be severed from the Terms without prejudice to the other provisions of the Terms. The other provisions of the Terms shall remain in force and effect.

Force majeure: The interruption of the communication lines of third-party providers is expressly agreed to constitute force majeure for which MOPTIL shall not be liable.

Modification of the terms and conditions herein: MOPTIL reserves the right to modify or renew the terms and conditions herein. MOPTIL undertakes to update this document with any changes or additions to the Terms.

The Terms and your relationship with MOPTIL under the Terms hereunder shall be governed by the laws of the Greek state. You and MOPTIL agree to submit to the exclusive jurisdiction of the courts of Athens. Notwithstanding the foregoing, you agree that MOPTIL still retains the right to file for injunctive relief (or to obtain an equivalent form of emergency relief) in any jurisdiction.

All the above terms are agreed to be essential.
